1. Introduction

Welcome to Choose Takeaway. These Terms and Conditions govern your use of our website and services. By accessing or using Choose Takeaway, you agree to be bound by these terms.

Choose Takeaway is a platform operated by ServeLogic that connects customers with local restaurants for direct ordering and delivery services.

2. Definitions

  • "We", "Us", "Our" refers to Choose Takeaway and ServeLogic
  • "You", "Your" refers to the user of our services
  • "Restaurant Partner" refers to restaurants listed on our platform
  • "Services" refers to our online ordering platform and related services

3. Use of Services

3.1 Eligibility

You must be at least 18 years old to use our services. By using Choose Takeaway, you represent and warrant that you meet this age requirement.

3.2 Account Registration

Account registration is handled directly by our Restaurant Partners. Choose Takeaway does not hold or store customer account data - this is a key difference from traditional third-party delivery platforms.

When you create an account to order from a restaurant:

  • Your account is created directly with the Restaurant Partner
  • The Restaurant Partner controls and stores your data
  • You are responsible for providing accurate information to the restaurant
  • You are responsible for maintaining the security of your account credentials
  • Any questions about your data should be directed to the Restaurant Partner

Choose Takeaway acts solely as a technology platform connecting you with restaurants. We do not retain customer data, giving restaurants full ownership of their customer relationships.

3.3 Prohibited Uses

You agree not to:

  • Use our services for any illegal purpose
  • Violate any laws in your jurisdiction
  • Infringe on intellectual property rights
  • Transmit viruses or malicious code
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of our services

4. Orders and Payments

4.1 Placing Orders

When you place an order through Choose Takeaway:

  • You are making an offer to purchase items from the Restaurant Partner
  • The Restaurant Partner reserves the right to accept or reject your order
  • Orders are confirmed when accepted by the Restaurant Partner
  • You will receive confirmation via SMS or email from the restaurant

4.2 Pricing

All prices displayed are in GBP (£) and include VAT where applicable. Restaurant Partners set their own prices. We do not add commission fees or service charges to menu prices.

4.3 Payment

Payment is processed securely through the Restaurant Partner's payment system. We accept major credit and debit cards. Payment is taken at the time of order placement.

4.4 Delivery Fees

Delivery fees, if applicable, are set by the Restaurant Partner and will be clearly displayed before checkout.

5. Delivery and Collection

5.1 Delivery Times

Estimated delivery times are provided by Restaurant Partners and are estimates only. We are not responsible for delays caused by factors beyond our or the Restaurant Partner's control.

5.2 Delivery Address

You are responsible for providing accurate delivery information to the Restaurant Partner. We cannot be held liable for orders delivered to incorrect addresses provided by you.

5.3 Collection Orders

For collection orders, you must collect your order from the Restaurant Partner at the specified time. Uncollected orders may be cancelled, and no refund will be provided.

6. Cancellations and Refunds

6.1 Cancellation by You

Once an order is confirmed by the Restaurant Partner, it cannot be cancelled unless the Restaurant Partner agrees. Contact the restaurant directly for cancellation requests.

6.2 Cancellation by Restaurant

Restaurant Partners may cancel orders in exceptional circumstances. You will receive a full refund if your order is cancelled by the restaurant.

6.3 Refunds

Refunds are processed at the discretion of the Restaurant Partner. Issues with food quality or order accuracy should be raised directly with the restaurant. Refunds typically take 5-10 business days to appear in your account.

7. Food Safety and Allergies

7.1 Allergen Information

While we encourage Restaurant Partners to provide allergen information, you are responsible for checking with the restaurant directly if you have food allergies or dietary requirements.

7.2 Food Safety

Restaurant Partners are responsible for food preparation and safety standards. We are not liable for foodborne illness or allergic reactions.

8. Intellectual Property

All content on Choose Takeaway, including text, graphics, logos, images, and software, is the property of ServeLogic or its content suppliers and is protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.

9. Limitation of Liability

9.1 Platform Role

Choose Takeaway is a technology platform that facilitates direct ordering between customers and Restaurant Partners. We do not:

  • Store or control customer personal data
  • Prepare, package, or deliver food
  • Set menu prices or delivery fees
  • Act as an intermediary in payment processing

The contract for food preparation, sale, and delivery is directly between you and the Restaurant Partner. Restaurant Partners retain full ownership of their customer relationships and data, distinguishing us from traditional third-party delivery platforms.

9.2 Liability Limits

To the fullest extent permitted by law, we shall not be liable for:

  • Food quality, safety, or preparation
  • Delivery delays or failures
  • Actions or omissions of Restaurant Partners
  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or data

Our total liability shall not exceed the amount you paid for the relevant order.

10. Data Protection

Important: Choose Takeaway does not collect, store, or process customer personal data. This is a fundamental difference from traditional delivery platforms.

When you place an order through Choose Takeaway:

  • Your personal data is provided directly to the Restaurant Partner
  • The Restaurant Partner is the data controller for your information
  • The Restaurant Partner is responsible for GDPR compliance regarding your data
  • Any data protection requests should be directed to the Restaurant Partner

11. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify you of significant changes by posting a notice on our website. Your continued use of our services after changes constitute acceptance of the modified terms.
